The education law makes primary education compulsory, not school attendance (art. 16) and explicitly states that "parents are the first educators of their children" (art. 22).

However, homeschooling is banned in Bosnia and Herzegovina. Pursuant to thearticle 23 of the Constitution, parents have the right to guarantee their children's education and can choose the type of education for their children that is most in line with their beliefs. However, these rights are limited by the requirement that such education still ensure the exercise of the child's right to an adequate education, limiting the parent's right to choose between public and private schools.
